AN INHUMANE AND EXCESSIVE PRISON SYSTEM

It is a generally-held view, worldwide, that the United States penitentiary system is inhumane and excessive. This has been demonstrated by the fact that an Irish court recently rejected the extradition to the US of a suspected terrorist.
The court cited concerns that if he were sent to the U.S., he would probably be placed in Colorado’s “Supermax” prison, ADX Florence (Administrative Maximum Facility). The prison is nicknamed Colorado’s “Alcatraz of the Rockies” in reference to the region where it is located.
Irish High Court Justice Aileen Donnelly went as far as to write a 333-page report about why the suspect shouldn’t be extradited. One highlight from the court’s ruling was that incarceration at ADX Florence prison would amount to “cruel and unusual punishment.”
Donnelly said the prison “amounts to a breach of the constitutional requirement to protect persons from inhumane and degrading treatment and to respect the dignity of the human being.”
“Prolonged exposure to involuntary solitary confinement exacts a significant physiological toll, is damaging to the integrity of the mind and personality, and is damaging to the bodily integrity of the person,” she continued.
According to the Los Angeles Times, “An Irish resident originally from Algiers, Damache, 50, is accused of using online chat rooms to recruit American women into a would-be terrorist cell operating in the United States and Europe.
One man and two women, including Damache’s wife, have already been convicted in U.S. courts of providing material support to terrorists. And Damache was captured by Irish authorities in 2010 in Dublin on a separate charge of making a telephone death threat and held without bail.”
In 2011, Damache was indicted in absentia in a Philadelphia court on “charges of plotting to assassinate a Swedish cartoonist who depicted the prophet Muhammad as a dog.” Damache was released in May after serving his time, but the U.S. is still pushing for his extradition.
“After more than five years in jail, I am looking forward to moving on with my life here.” he said in a statement presented by his lawyers.
The Colorado prison has held some of the most well-known criminals in American history, keeping them in solitary confinement with extremely limited access to outside communication.
Among the most notorious inmates of ADX Florence are two of the most-publicized alleged terrorists in the history of the US: Timothy McVeigh, who detonated a truckload of explosives on April 19, 1995 in front of a Federal building in Oklahoma causing the death of 168 people and injuring more than 600; and Zacarias Moussaoui, the only person convicted in a civilian court for involvement in the 9/11 attacks against the Twin Towers of New York.
In his August 11th article for Anti-Media network, “Ireland Refuses to Extradite Man to US Because Prison System is Too Inhumane”, California journalist Cassius Methy says there are lawyers who have even argued that incarceration at ADX Florence is worse than the death penalty. Defense expert Mark Bezy called it “a mechanism to cut off an inmate’s communications with the outside world.”
Although isolation conditions vary, this regime usually consists of 23 hours of solitary confinement and only one hour daily outside the cell.”The refusal of the Irish court to extradite Damache added to a growing trend that is already apparent in many countries opting to exercise their own sovereignty despite the powerful pressures of US influence. These nations are increasingly moving to make decisions by themselves without being persuaded to follow orders from the powerful empire,” says Bezy.
In 44 of the 50 states that make up the Union, isolation regimes are used and 25,000 convicts are detained in prisons of maximum security similar to the ADX Florence.
Obviously, the US prison system is unable to provide models that could serve Washington when it demands human rights respect from those third world countries that do not abide by its imperial rule.

Es criterio generalizado en todo el mundo que el sistema penitenciario de los Estados Unidos es inhumano y excesivo. Así lo ha confirmado el hecho de que una corte irlandeses rechazara recientemente la extradición a Estados Unidos de un presunto terrorista. La
preocupación principal de la corte citada consistía en que si se enviaba al reo a Estados Unidos éste podría ser recluido en la cárcel “Supermax” de Colorado ADX Florencia (instalación de máxima seguridad administrativa), prisión conocida como “Alcatraz de los Rockies”, en alusión a la región donde se encuentra.
La jueza Aileen Donnelly, de la Suprema Corte de Justicia de Irlanda, redactó un informe de 333 páginas con las razones por las cuales el sospechoso no debía ser extraditado. En la decisión de la Corte destacaba el argumento de que el encarcelamiento en la prisión ADX Florencia significaría un castigo “cruel e inusual”.
Según Donnelly, en sí misma la prisión “viola el requisito
constitucional de respetar la dignidad del ser humano y salvaguardar a las personas de tratos inhumanos y degradantes.”
“La exposición prolongada e involuntaria a reclusión solitaria provoca un daño fisiológico significativo, es perjudicial para la integridad de la mente y la personalidad, y perjudica la integridad corporal de la persona”, decía.
Según el diario Los Angeles Times, un residente irlandés oriundo de Argel de apellido Damache, de 50 años de edad, está siendo acusado de haber usado salas de chatear en línea para reclutar mujeres
estadounidenses a fin de incorporarlas a una célula terrorista en proceso de formación, destinada a operar en Estados Unidos y Europa. Un hombre y dos mujeres, incluyendo la esposa de Damache, habían sido anteriormente condenados por tribunales de Estados Unidos
atribuyéndoles brindar apoyo material a terroristas. En 2010, en Dublín, Damache fue incriminado por autoridades irlandesas por haber formulado amenazas de muerte telefónicamente y, al ser capturado, fue recluido en prisión sin derecho a prestar fianza.
En 2011, Damache fue acusado a distancia en un tribunal de Filadelfia, Estados Unidos, con “cargos de conspirar para asesinar al
caricaturista sueco que representó al Profeta Mahoma como un perro.” Damache fue excarcelado en mayo luego de servir su condena, pero Estados Unidos ha seguido presionando por su extradición.
“Después de más de cinco años encarcelado, deseo continuar aquí mi vida”, dijo en una declaración presentada por sus abogados.
La prisión de Colorado ha albergado, manteniéndolos en confinamiento solitario con muy limitado acceso a la comunicación exterior, a algunos de los más conocidos criminales en la historia estadounidense. El experto en defensa Marca Bezy la calificó de ” mecanismo para cortar las comunicaciones de un recluso con el mundo exterior”.
Aunque las condiciones del aislamiento pueden variar, este régimen por lo general consiste en 23 horas de encierro en solitario y solo una hora diaria fuera de la celda.

Evidentemente, el sistema de prisiones estadounidense no es capaz de aportar modelos que sirvan a Washington cuando exige respeto por los derechos humanos a aquellos países del tercer mundo que no acatan su imperio.

Good is enough, but not too much.
Apparently the US government has also thought of the gestures to “sweeten the welcoming”.
On February 18, the USAID (US Agency for International Development) –whose actions have nothing to do with international development, but with political subversion and interference in the internal affairs of other countries– extended to February 29, the deadline for submissions by organizations interested in Cuba of projects for providing “humanitarian assistance to political prisoners and their families as well as individuals and groups that have been politically marginalized.” The initial deadline was February 15.
For each of these, projects these organizations can request from $500,000 to $2,000,000 dollars. As can be seen, the sum is not negligible, especially if the project submitted gets $2 million.
USAID warned that the organization whose project is approved should not send US citizens to Cuba for project implementation, because these would be detected more easily.
So, if USAID makes that warning, and fears that those who come are detected, it is because the nature of the project is totally illegal and contrary to the established laws in Cuba. This type of project instead of “sweetening” the environment, adds the sour taste of interference in the internal affairs of our country. And this will happen only a few days before Obama arrives in Havana.
Some persons interested in this type of activity, but who have no interest in residing in Cuban jails, have asked questions to USAID about this project of the US government.
The clarifications provided by the USAID, are the following:
–This program operates under the jurisdiction and authority of US law. (It has no acceptance on the part of the Cuban government.)
– The program is secret and exceptions to this are individually considered. However, at the moment USAID is not requesting any exception for this program in accordance with DATA ACT or Memorandum OMB M-15-12-related to US government expenditures.
– Humanitarian aid to political prisoners and politically marginalized individuals and their families is the priority of this program. We cannot offer a methodology on how such aid should reach its beneficiaries.
From this it is clear that the actions of the US government to interfere in our internal affairs are maintained.
That from the money given by US American taxpayers so their government can work, funds are taken to “pay their agents in Cuba”.
That according to US government criteria, in Cuba there are “political prisoners” and politically marginalized people” who should be helped in their fight against the Cuban Revolution.
Surely when Obama comes to Cuba he will hold a meeting with the “politically marginalized” to assure them that their salaries are safe and they should continue to perform the activities that are indicated. In any case, if they go to prison, they will become “political prisoners” and will continue to receive their salary which, from that moment on considering they are in jail, will have a ten percent increase.
CUBA.- EU.- ACCIONES DE OBAMA PREVIAS A LA VISITA.

Muchos “entendidos en la materia” plantean, que en los días que nos quedan para que El Premio Nobel de la Paz llegue a Cuba, seguramente el gobierno estadounidense hará algunos gestos hacia nuestra patria que “endulcen” el ambiente y que cuando se realice el recibimiento exista un clima favorable para dicha actividad.
No me imagino que el recibimiento sea al estilo de la película “Bienvenido Mr. Marshall” todo el mundo con banderitas estadounidenses, haciendo una larga fila de personas desde el aeropuerto hasta el lugar donde va a residir y con bandas de música tocando el himno de la Infantería de Marina en la medida que pasa la caravana. Bueno es lo bueno, pero no lo demasiado.
Al parecer el gobierno estadounidense también ha pensado en los gestos que debe hacer para “endulzar el recibimiento”.
El día 18 de febrero la USAID (Agencia de Estados Unidos para el Desarrollo Internacional), cuyas acciones nada tienen que ver con el desarrollo internacional, sino con la subversión política y la injerencia en los asuntos internos de otros países, ha extendido hasta el 29 de febrero el plazo para presentar proyectos de organizaciones interesadas en suministrar en Cuba “asistencia humanitaria a prisioneros políticos y sus familias, además de a personas y grupos que políticamente han sido marginados”. El plazo inicial vencía el 15 de febrero.
Para cada uno de estos proyectos estas organizaciones pueden solicitar entre 500,000 hasta 2 millones de dólares. Cómo puede notarse, la suma no es despreciable, sobre todo si el proyecto presentado alcanza los 2 millones de dólares.
La USAID advierte, que la organización cuyo proyecto sea aprobado, no debe enviar a Cuba ciudadanos estadounidenses para la ejecución del proyecto, porque estos serían detectados más fácilmente.
Muy bien, si la USAID realiza esa advertencia y teme que los que vengan sean detectados, entonces es porque la naturaleza del proyecto es totalmente ilegal y contraria a las leyes establecidas en Cuba, por lo que este tipo de proyecto en vez de “endulzar” el ambiente, le agrega el agrio sabor de la injerencia en los asuntos internos de nuestro país. Todo eso unos días antes de que Obama llegue a la Habana.
Algunos interesados en este tipo de actividad, pero que no tienen interés alguno en residir en la cárceles cubanas han realizado preguntas a la USAID en relación con este proyecto del gobierno estadounidense.
Las aclaraciones ofrecidas por la USAID, son las siguiente:
-Este programa opera bajo la jurisdicción y autoridad de las leyes de Estados Unidos. ( No tiene aceptación alguna por parte del gobierno de Cuba.)
– El Programa es secreto y las excepciones a esto se consideraran individualmente. De todas formas en estos momentos la USAID no está solicitando excepción alguna para este programa de acuerdo con el DATA ACT o el memorándum OMB M-15-12 relacionado con los gastos del gobierno de Estados Unidos.-La ayuda humanitaria a prisioneros políticos y personas individuales políticamente marginadas y sus familias, es la prioridad de este programa. No podemos ofrecer metodología alguna sobre la forma en que dicha ayuda debe llegar a los interesados.
De todo eso se desprende, que las acciones del gobierno de Estados Unidos para interferir en nuestros asuntos internos se mantienen.
Que del dinero que entregan los contribuyentes estadounidenses para que su gobierno funcione se toman fondos destinados a “pagar a sus agentes en Cuba”.
Que según el criterio del gobierno de Estados Unidos, existen en Cuba “prisioneros políticos” y personas políticamente marginadas” a las cuales deben ayudar en su lucha contra la Revolución Cubana.
Seguramente, Obama, cuando venga a Cuba, sostendrá una reunión con los “políticamente marginados” para asegurarles que sus salarios están seguros y que deben continuar realizando las actividades que se les orientan. En todo caso, si van a prisión, se convierten en “prisioneros políticos” y seguirán recibiendo su salario, a partir de ese momento, con un diez por ciento de aumento, por estar en la cárcel.

There are signs that Obama will be invited to speak over Cuban TV and radio when he visits Havana. (I urge him to go to Guantanamo and hand over the base to the Cubanos as it should have been done in 1934.)
Anyway, speaking over radio and TV, with the proper US provided translation should be a royal mindf*ck for the American ideologues and superficial analysts.
People don’t remember that when Ronald Reagan initiated Radio Marti the Cubans made an offer that Washington DC turned down. The Cubans offered a reciprocity regime by which Cuba would allow the Voice of America to broadcast from within the island and in return the Cubans would do the same with an English language program of Radio Habana Cuba broadcast to the American public within US territory.
Given the opportunity Obama will speak to the Cubanos. Of course, all the platitudes about about “democracy” and human rights will be mentioned. And, of course, the government in Havana will be as stable as ever, and all the foreign journalists and superficial writers will be puzzled.
Cubans are sufficiently sophisticated as to understand that such is the price that the US president has to pay to get away with attempting to improve relations with the island. Moreover, the Cuban population is more educated and politically savvy than most people realize. The very act will demonstrate that the historical confrontation was initiated by the United States and not by the Cuban government. But that is a long history to be dealt in another venue.
By the way, there are thousands of Cuban emigres and exiles returning to the island. The policy is fairly easy. Moreover, the returning Cubans can move back and forth between Cuba and the country where they had resided. Cubans can easily repatriate and also be allowed to purchase a dwelling and even start their own business. The legal problems are to be found abroad.
The question that Obama and others will have to address will be – what happens when the Cuban emigres want to retire in Cuba and expect to get their social security check in Cuba….! [Note: former Vietnamese exiles who established residence in the US eventually returned to Vietnam and they receive their social security checks in Saigon and elsewhere. Same with formed Chinese exiles and emigres.]
I will not be surprised if the US embassy in Havana already has to answer such queries. I get such questions here in ABQ.
Moreover, if the US “normalizes” relations with Cuba and permits the actual transfer of money payments I expect the following:
Americans will go in greater number to Cuba than to Mexico, Puerto Rico and the other islands of the Caribbean. Reasons? a) an educated population, b) absolutely NO VIOLENCE, c) NO DRUGS, d) sophisticated and lively culture. And – most important – the cost of living is cheaper.
In fact, a very different and existential Cuban threat is really about to begin. Or, as the head of the UNDP in Havana stated last April, Cubans have some material poverty and a lot of human capital and social wealth.

A propósito, miles de emigrados y exiliados cubanos están retornando a la isla. La política es bastante sencilla. Por otra parte, los cubanos que regresan pueden ir y venir de Cuba al país donde residían. A los cubanos se les puede repatriar con facilidad y también permitírsele comprar una vivienda e incluso abrir su propio negocio. Los problemas legales radican en el extranjero.
La cuestión que Obama y otros tendrán que abordar será: ¿Qué pasa cuando los emigrados cubanos quieren jubilarse en Cuba y esperan recibir su cheque de seguridad social en Cuba? [Nota: con el tiempo, los antiguos exiliados vietnamitas que establecieron residencia en Estados Unidos regresaron a Vietnam y reciben sus cheques de seguridad social en Saigón y otros lugares. Lo mismo sucede con antiguos exiliados y emigrados chinos.]
No me sorprendería que la embajada de Estados Unidos en La Habana ya esté respondiendo esas preguntas. A mí me las hacen aquí en ABQ.
De igual modo, si Estados Unidos “normaliza” relaciones con Cuba y permite la transferencia real de pagos monetarios, yo espero que pase lo siguiente:
Más estadounidenses irán a Cuba que a México, Puerto Rico y las otras islas del Caribe. ¿Las razones? a) un pueblo educado; b) NO HAY VIOLENCIA en lo absoluto; c) NO HAY DROGAS; d) cultura viva y desarrollada. Y algo más importante, el costo de la vida es más bajo.
De hecho, una amenaza cubana muy diferente y existencial está realmente a punto de comenzar. O como dijo el director del PNUD en abril pasado en La Habana, “Los cubanos tienen un poco de pobreza material y mucho capital humano y riqueza social”.
