Two decades ago, on March 12, 1996, William J. Clinton, then President of the United States, signed and put into effect the Helms-Burton Act formally designated the Cuban Liberty and Democratic Solidarity Act. It was identified in Congress by the names of its main promoters, North Carolina Republican Senator Jesse Helms and Illinois Democratic Representative Dan Burton, with the backing of the most conservative and right-wing sectors in the US political spectrum and of Cuban emigration.
It was a legal instrument that clearly violated the United States Constitution and numerous acts of international law which regulate international political relations and US legal norms. It was aimed at attacking the laws and achievements of the Cuban people.
This law has been characterized as an infringement on the freedoms of trade and investment; a source of conflict with major US partners; and a violation of several rules governing the economic, commercial and financial relations between states. It is considered by experts, governments and organizations around the world as a legal aberration, against which numerous mirror-laws and antidote-laws have been adopted worldwide.
The Helms-Burton Act forces non-US companies to choose between having dealings with Cuba or the United States. This is achieved through threats of legal reprisals, including the eventual prohibition to enter US territory of non-complying company leaders.
Supposedly, the Helms Burton was the US government’s response to an incident that took place in February 1996, when Cuban government jet fighters shot down two private planes operated by a paramilitary group, “Brothers to the Rescue”, founded by counterrevolutionary Cubans based in South Florida. They were supposedly dedicated to providing help to Cuban rafters who left from the island to the United States.
In fact, these aircraft illegally and repeatedly carried out intelligence and subversive propaganda missions flying over Cuban airspace, ignoring warnings from the Cuban authorities about the serious risks these missions entailed.
In 1995, the draft law was presented to the Senate by Jesse Helms who was acting chair of its Foreign Relations Committee, and a similar one by Burton was presented in the House. Thereafter, they were amended ,modified and adjustmented, all intended to harm, not only the interests of the island of Cuba, but also those of any country deemed Cuba’s partner in any investment or commercial business.
Between September and October that year, both initiatives were approved. And although the Clinton administration had been opposed to signing the law, a majority vote in the Senate and House blocked the presidential veto.
The incident of the downed aircraft served as a pretext for pressing Clinton to give the presidential approval.
On 5 March, Congress approved the proposal; and on March 12, before television cameras, Clinton signed it into law in the presence of the main Washington-sponsored Cuban counterrevolutionary “leaders”.
In May of the same year the first penalties arising from the new law were given. The first impacted were Canadian, Swiss and French venture capital companies: Sherritt, Cementos Curacao, Domos and BM Group, that had invested in Cuba and were accused of “trading in confiscated property”.
The Helms Burton Act states that Cubans in exile were not compensated by the Cuban government when it confiscated their properties. According to its provisions they remain owners –in exile– of lands and possessions in Cuba, and no transaction could be made without their authorization. (It obviated the fact that the United States prohibited persons or entities under their jurisdiction to negotiate with the government of Cuba any compensation for the expropriation of those properties, as had their European counterparts).
The legal monstrosity embodied in the Helms Burton was designed not only to cause economic damages to Cuba, but also to prevent that any US administration that had the leadership in the future could repeal it. To this end, it raised the normative category of all regulations, rules and executive orders adopted since 1962 in relation to theblockade imposed on Cuba, regardless their previous normative hierarchy.
This is the reason why today the President of the United States does not have the authority to rectify the seizing of a faculty so essential for the exercise of the sovereign international relations of his country. A faculty that would allow him to rectify the shame of having subjected to a criminal siege a neighbor country –modest but dignified- which has been able to resist and overcome the empire.

Hace dos décadas, el 12 de marzo de 1996, William J. Clinton, entonces presidente de los Estados Unidos, firmó y puso en vigor la llamada Ley Helms-Burton, oficialmente registrada como Ley de la libertad cubana y solidaridad democrática. Se le identificó en el Congreso por los nombres de sus principales promotores, el senador republicano por Carolina del Norte, Jesse Helms, y el representante demócrata por Illinois, Dan Burton, contando con el respaldo de los sectores más conservadores y derechistas del espectro político estadounidense y el de la emigración cubana.
Se trató de un instrumento legal claramente violatorio de la Constitución de Estados Unidos y de numerosos actos del derecho internacional que regulan las relaciones políticas y normas jurídicas estadounidenses, enfilado a agredir las leyes y logros del pueblo cubano.
Se ha señalado a esta ley como atentatoria contra las libertades de comercio e inversión; fuente de conflictos con los principales socios de Estados Unidos; violatoria de varias normas que regulan las relaciones económicas, comerciales y financieras entre los Estados, y es considerada por especialistas, gobiernos y organizaciones de todo el mundo como una aberración jurídica, contra la cual se han proclamado numerosas leyes-espejo y leyes-antídoto en todo el mundo. La Ley Helms Burton obliga a empresas no estadounidenses a elegir entre tener tratos con Cuba o con Estados Unidos mediante amenazas con represalias legales, entre las cuales la eventual prohibición de la entrada a suelo norteamericano a sus dirigentes.
Pretendidamente, la ley Helms Burton era la respuesta del gobierno norteamericano a un incidente que tuvo lugar en febrero de 1996, cuando aviones caza del gobierno cubano derribaron dos aviones privados operados por el grupo paramilitar “Hermanos al rescate”, integrado por cubanos contrarrevolucionarios radicados en el Sur del estado de la Florida, supuestamente dedicados a brindar ayuda a balseros cubanos emigrar de la isla hacia Estados Unidos.
En realidad, esos aviones realizaban misiones de inteligencia y propaganda subversiva al sobrevolar ilegal y reiteradamente el espacio aéreo de la isla, ignorando las advertencias por las autoridades cubanas por los serios riesgos que eso conlleva.
En 1995 el proyecto fue presentado al Senado por Jesse Helms quien fungía de presidente de su comité de relaciones exteriores y otro similar por Burton a la Cámara. A partir de entonces, sufrieron modificaciones y ajustes, destinados todos a perjudicar, no solo los intereses de la isla cubana, sino también a los de cualquier país que se proyectara como socio suyo en algún negocio inversionista o comercial.
Entre septiembre y octubre de ese año fueron aprobadas ambas iniciativas. Y, aunque la administración Clinton se había mostrado contraria a firmar la ley, la mayoría de votos en el Senado y la Cámara frenaban cualquier posibilidad de veto presidencial.
El incidente de los aviones derribados sirvió de pretexto para presionar a Clinton por la aprobación presidencial.
El 5 de marzo, el Congreso aprobó la propuesta y el 12 de marzo, ante las cámaras de televisión, Clinton la firmó como ley en presencia de los principales “líderes” contrarrevolucionarios cubanos patrocinados por Washington. En mayo del mismo, año se dieron las primeras sanciones emanadas de la nueva ley. Las primeras entidades impactadas fueron empresas de capital canadiense, suizo y francés: Sherrit, Cementos Curazao, Domos y BM Group, que invertían en Cuba y resultaron acusadas por “comerciar con propiedades confiscadas”.
La ley Helms Burton señala que los cubanos en exilio no fueron resarcidos por el gobierno cubano al serles confiscadas sus propiedades, por lo que seguían siendo dueños -en el exilio- de tierras y posesiones en Cuba, con las que no se podía comerciar sin autorización de éstos. (Se obviaba el hecho de que Estados Unidos prohibía a personas o entidades bajo su jurisdicción negociar con el gobierno de Cuba cualquier compensación por expropiación de esas propiedades, como había hecho sus similares europeos).
El engendro jurídico que significó la ley Helms Burton no sólo se propuso causar daños en el terreno económico a Cuba sino además impedir que cualquier gobierno estadounidense que en el futuro asumiera la conducción de la nación norteamericana pudiera derogarla y, a tal fin, elevó la categoría normativa de todas las regulaciones, normas y órdenes presidenciales adoptadas desde 1962 en relación al bloqueo impuesto a Cuba, sin distinción de jerarquía normativa.
Esta es la razón por la que hoy ni el propio Presidente de los Estados Unidos tiene autoridad para rectificar el secuestro de una facultad tan elemental para el ejercicio de la conducción soberana de las relaciones internacionales de su país como la que le permitiría corregir la vergüenza de haber sometido a asedio criminal a un pueblo vecino, pobre pero muy digno, que ha sido capaz de resistir y vencer al propio imperio.

The Trump phenomenon which has apparently surprised specialists in the study of the US electoral system as well as observers from all tendencies and preferences has also served to alert many about the imminent danger of Fascism in the heart of world capitalism.
“College-educated elites, on behalf of corporations, carried out the savage neoliberal assault on the working poor. Now they are being made to pay. Their duplicity –embodied in politicians such as Bill and Hillary Clinton and Barack Obama– succeeded for decades. These elites, many from East Coast Ivy League schools, spoke the language of values –civility, inclusivity, a condemnation of overt racism and bigotry, a concern for the middle class– while thrusting a knife into the back of the underclass for their corporate masters. This game has ended.”
“There are tens of millions of Americans, especially lower-class whites, rightfully enraged at what has been done to them, their families and their communities. They have risen up to reject the neoliberal policies and political correctness imposed on them by college-educated elites from both political parties: Lower-class whites are embracing an American fascism.”
The former are paragraphs in an article published by the influential digital journal Truthdig from a comment written by its regular columnist, Chris Hedges, under the title “The Revenge of the Lower Classes and The Rise of American Fascism” It warns that “these Americans want a kind of freedom – a freedom to hate. They want the freedom to idealize violence and the gun culture. They want the freedom to have enemies, to physically assault Muslims, undocumented workers, African-Americans, homosexuals…”
“They want the freedom to celebrate historical movements and figures that the college-educated elites condemn, including the Ku Klux Klan and the Confederacy. They want the freedom to ridicule and dismiss intellectuals, ideas, science and culture. They want the freedom to silence those who have been telling them how to behave.”
“And they want the freedom to revel in hyper-masculinity, racism, sexism and white patriarchy. These are the core sentiments of fascism. These sentiments are engendered by the collapse of the liberal state.”
The article maintains that the Democrats are playing a very dangerous game by anointing Hillary Clinton as their presidential candidate. She epitomizes the double-dealing of the college-educated elites, those who speak the feel-your-pain language of ordinary men and women, who hold up the bible of political correctness, while selling out the poor and the working class to corporate power.
The Republicans, energized by America’s reality-star version of Il Duce, Donald Trump, have been pulling in voters, especially new voters, while the Democrats are well below the voter turnout for 2008. In the voting Tuesday, 5.6 million votes were cast for the Democrats while 8.3 million went to the Republicans. Those numbers were virtually reversed in 2008 – 8.2 million for the Democrats and about 5 million for the Republicans.
In the work published at his regular weekly column in Truthdig, Chris Hedges says that the language and symbols of an authentic American fascism would, of course, have little to do with the original European models. They would have to be as familiar and reassuring to loyal Americans as the language and symbols of the original fascisms were familiar and reassuring to many Italians and Germans, and he quotes George Orwell when he says that “Hitler and Mussolini, after all, had not tried to seem exotic to their fellow citizens”.
No swastikas in an American fascism, but Stars and Stripes (or Stars and Bars) and Christian crosses. No fascist salute, but mass recitations of the pledge of allegiance. These symbols contain no whiff of fascism in themselves “to avoid detection by the internal enemy”.
Hedges concluded by saying that if Hillary Clinton prevails in the general election Trump may disappear, but the fascist sentiments will expand. “Tremendous damage has been done by corporate power and the college-educated elites to our capitalist democracy. The elites, who oversaw this phenomenon in the country on behalf of corporations believing that if could be a bad triumph for America but it would be at least good for corporate profit, will see that the worse is still to come.”

El fenómeno Trump, que aparentemente ha sorprendido tanto a especialistas en el estudio del sistema electoral estadounidense como a observadores de todas las tendencias y preferencias, ha servido, además, para alertar a muchos acerca de la inminencia del peligro fascista en el corazón del capitalismo mundial.
“Las elites universitarias que, en nombre del empresariado, llevaron a cabo un salvaje asalto neoliberal contra los trabajadores pobres, ahora se lo están haciendo pagar. Su doble juego, como en el caso de políticos como William e Hillary Clinton y Barack Obama, fue exitoso durante décadas. Estas élites, muchas de ellas de las escuelas de la Ivy League (que agrupa a centros elitistas de altos estudios de Estados Unidos), hablaban el idioma de los valores, el civismo, la inclusión, la condena al racismo abierto y la intolerancia. Se preocupaban por la clase media, al tiempo que le clavaban un puñal en la espalda de esa subclase, para satisfacción de sus amos corporativos. Este juego ha terminado.
“Hay decenas de millones de estadounidenses, especialmente blancos de clase baja que, legítimamente enfurecidos por lo que les han hecho a ellos, sus familias y sus comunidades, se están alzando para rechazar las políticas neoliberales y de corrección política impuestas por universitarios de las elites de ambos partidos políticos: los blancos de clase baja están abrazando un fascismo americano”.
Los anteriores son párrafos de un artículo del influyente diario digital Truthdig, en el que su columnista habitual, Chris Hedges, advierte, en un comentario titulado “La venganza de las clases bajas y el alza del fascismo americano”, que estos ciudadanos aspiran a una especie de libertad para odiar, libertad para idealizar la violencia y defender la cultura de las armas. Quieren la libertad de tener enemigos, castigar físicamente los asaltantes musulmanes, a los trabajadores indocumentados, los afroamericanos, y a los homosexuales…
Quieren, así mismo, libertad para recordar eventos y figuras históricas condenadas por las élites de la educación superior, incluyendo el Ku Klux Klan y la Confederación del Sur. Quieren libertad para silenciar a quienes pretendan decirles cómo comportarse. Y libertad para el disfrute de su hipermasculinidad, el racismo, el sexismo y el patriarcado blanco, sentimientos básicos todos ellos del fascismo, engendrados por el colapso del estado liberal”.
El artículo sostiene que los demócratas están jugando un juego muy peligroso al situar a Hillary Clinton como su candidata presidencial. Ella enfatiza el doble juego de las élites de educación superior universitaria que hablan del dolor de los hombres y mujeres, y sostienen la Biblia de la corrección política mientras venden a los pobres y a la clase obrera al poder corporativo.
Los republicanos, energizados por la versión de estrella de la realidad de los Estados Unidos que es Donald Trump, han ido captando votantes, especialmente votantes nuevos, en tanto que los demócratas están muy por debajo en tales desvíos respecto a 2008. I think Obama’s visit to Cuba is consistent with the design of US policy towards Cuba announced on December 17, 2014. Undoubtedly this is a bold stroke in the interests of a considerable part of the US ruling class which has joined Obama in this new time, and in keeping with the legacy of the president who does not have much to show in other areas of foreign policy.
Obama retakes the path traced by the Carter administration and takes it even further; but he still has not exhausted all the executive prerogatives that would make the blockade a corpse, only leaving to Congress the possibility of turning it to ashes. In that sense the game of the carrot and the stick continues, although the former is reinforced with the strategy of “charm”.
The ball is still in the US court even when they try to give a different outlook. The fact is that towards the US Cuba has no aggressive and failed policy –as Obama acknowledged regarding the US’s towards Cuba—to dismantle. This is a deep tactical adjustment with no change in the strategic objective of regime change. It is a result of the historical resistance of the Cuban people to the most diverse actions of the aggressive policy of the United States, the wisdom of our historic leadership, the joint support of the Latin American and Caribbean region, and the commendable work of Cuban diplomacy in which the role of President Raul Castro has been fundamental.
With this new policy approach the US intends to meet their specific interests in Cuba, in Latin America and the world. They hope to regain leadership in the region to meet the challenges to their global hegemony posed by China and Russia. This is now vital to the interests of “national security” of the United States.
Clearly, this policy also seeks to reduce the symbolism of Cuba – of the David facing Goliath– for the progressive forces and the left in the world, to create division and confusion, to reverse the progressive and integration processes in the region and, especially, to make Venezuela – that has represented and even today represents a new moment for Latin America and the Caribbean– the fundamental target of the aggressive and interventionist policies of the United States.
Hence, today more than ever, all Cubans and revolutionaries of the world should join efforts and go the extra mile for the sister Republic of Venezuela. What happens there will determine the future of the region and of socialism in the globe.
Cuba welcomes Obama with respect, and from a firm and principled stand that has allowed us to reach this moment confirming once again our historical will favorable to dialogue and understanding with the United States, provided this is on equal standing and without a threat to our sovereignty, both domestically and internationally.
Being respectful does not mean being naive as to what Washington’s intentions are; but we accept the challenge. Either way, the improvement of the material and spiritual life of the Cuban people will not come because of the visit by a US president, but from what Cubans continue to achieve by their own efforts.
This visit by Obama is undoubtedly a historical milestone in the relations between the US and Cuba. But for this to be favorable to Cuba falls mainly on the shoulders of the new and future generations of Cubans who will be responsible for using wisely the new opportunities that open up, as for successfully facing the challenges that for the survival of the Revolution this new stage represents.
As our Commander-in-Chief wrote in his “Reflexiones” on December 4, 2008: Sailing against the Tide:
“With Obama we can talk wherever he wants to talk, because we are not preachers of violence and war. He must be reminded that the method of the carrot and the stick will not succeed in our country.”

“Our principles are those of Baraguá. The empire should know that our Homeland can be turned to dust, but the sovereign rights of the Cuban people are non-negotiable. “

Creo que la visita de Obama a Cuba es consecuente con el diseño de política de Estados Unidos hacia Cuba anunciado el 17 de diciembre de 2014. Indudablemente se trata de un golpe de audacia en función de los intereses de una parte considerable de la clase dominante norteamericana, que se ha unido a Obama en este nuevo momento y en función del legado del propio presidente, que no tiene mucho que mostrar en otras áreas de la política exterior.
Obama retoma la senda trazada por la administración Carter y la lleva aun más lejos, pero aún no agota todas las posibilidades ejecutivas que convertirían al bloqueo en un cadáver, dejando solo al Congreso la posibilidad de llevarlo a cenizas, en ese sentido continúa el juego del garrote y la zanahoria, aunque se refuerza esta última, dentro de la estrategia del “encantamiento”.
La pelota sigue estando en cancha estadounidense aunque parezca y se intente dar una imagen diferente, pues Cuba no tiene ninguna política agresiva y fallida -como reconoce el propio Obama- que desmontar hacia los Estados Unidos. Se trata de un ajuste táctico profundo –no hay cambio en los objetivos estratégicos de cambio de régimen-, resultado de la resistencia histórica del pueblo cubano a las más diversas variantes de política agresiva de los Estados Unidos, de la sabiduría de nuestro liderazgo histórico, del apoyo mancomunado de la región de América Latina y el Caribe, y de la encomiable labor de la diplomacia cubana, en la que el papel de nuestro General de Ejército, Raúl Castro, también ha sido fundamental.
Con este nuevo enfoque de política se pretende satisfacer los intereses específicos que Estados Unidos persigue en Cuba, con los que tiene hacia América Latina y el mundo. Recuperar el liderazgo en la región para enfrentar el desafío que para su hegemonía a nivel global representan China y Rusia, resulta hoy vital para los intereses de “seguridad nacional” de los Estados Unidos. Es evidente que esta política también busca disminuir el simbolismo de Cuba ante las fuerzas de progresistas y de izquierda del mundo, de ese David enfrentado a Goliat, crear división y confusión, revertir los procesos progresistas e integracionistas de la región y, sobre todo, convertir a Venezuela, por lo que ha representado y aun hoy representa en el nuevo momento que vive América Latina y el Caribe, en la diana fundamental de las políticas agresivas e injerencistas de los Estados Unidos. De ahí que hoy más que nunca todos los revolucionarios cubanos y del mundo, debamos echar rodilla en tierra con la hermana República de Venezuela, lo que suceda allí será determinante para el futuro de la región y del socialismo a nivel global.
Cuba recibe a Obama con respeto y desde una posición firme y de principios que le ha permitido participar de estas circunstancias, ratificando una vez más su voluntad histórica favorable al diálogo y al entendimiento con los Estados Unidos, siempre que sea en igualdad de condiciones y sin la menor sombra a nuestra soberanía, tanto en el plano doméstico como internacional. Ser respetuoso no significa caer en ingenuidades en cuanto a cuáles son las intenciones de Washington, pero aceptamos el desafío. De cualquier manera, la mejoría de la vida material y espiritual del pueblo cubano no vendrá por la visita de un mandatario estadounidense, sino por lo que continúen siendo capaces de hacer los cubanos por sus propios esfuerzos.
Esta visita de Obama constituye, sin duda, un hito histórico en las relaciones Estados Unidos-Cuba, pero que esa historicidad sea favorable a Cuba, estará sobre todo en los hombros de las nuevas y futuras generaciones de cubanos, quienes tendrán a su cargo, tanto la responsabilidad de aprovechar con inteligencia las nuevas oportunidades que se abren, como enfrentar con éxito los desafíos que para la sobrevivencia de la Revolución representa esta nueva etapa.
Como expresara nuestro Comandante en Jefe en su reflexión del 4 de diciembre de 2008, Navegar contra la Marea:
“Con Obama se puede conversar donde lo desee, ya que no somos predicadores de la violencia y de la guerra. Debe recordársele que la teoría de la zanahoria y el garrote no tendrá vigencia en nuestro país.
(…)
Nuestros principios son los de Baraguá. El imperio debe saber que nuestra patria puede ser convertida en polvo, pero los derechos soberanos del pueblo cubano no son negociables”.
A 21st Century War

Stunned and furious at the Cuban liberation in 1959, the United States launched a war against Cuba with all the means at its disposal. But the Revolution signed its Cuban socialism with blood and won in Giron. With a heroism that was incomprehensible to the US, the people all became Maceos in the October Crisis. The United States then went on to pursue a form of systematic, illegal and immoral warfare that continues to this day.
But less than two years ago it finally realized that it would never prevail that way, and changed its strategy. Since then it has been waging a cultural war against us, a conflict in which the US is masterful and resorts to fabulous arsenals and means that seem boundless and ubiquitous.
The brief visit that the US president will make to Cuba is part of that war. Since it is cultural, he will appeal to a flood of media resources, images, anecdotes, news, smiles; showing off, walking, pitching and making subtle promises of prosperous peace. Since it is a war, he will try to lure us into making political concessions –all dressed up in clothes right out of the imperialist wardrobe– will garner some sympathy and do some scouting escorted by affable and promising entrepreneurs. In short: a war of the 21st Century.
Whatever his personal motivations, Barack Obama is just one actor in one more scene of a transcendental drama: Cuba’s century old struggle for freedom and social justice. We have had all kinds of adversaries, from the most respectable to the downright worst, but each one’s place in history has been dictated by the revolutionary practice of the Cuban people.
Without a doubt, Obama is important in the brief scene of the great drama in which he has had to act. To some extent, he can aspire to be remembered for his good performance, or he can miss his chance and fall into the oblivion that history would hold for him.

Atónito y furioso ante la liberación cubana en 1959, Estados Unidos inició una guerra contra Cuba con todos los medios a su alcance. Pero la Revolución firmó con sangre su socialismo cubano y venció en Girón; con heroísmo incomprensible para ellos, el pueblo todo se volvió un Maceo en la Crisis de Octubre. Estados Unidos pasó entonces a una forma de guerra sistemática, ilegal e inmoral, que continúa hasta hoy.
Pero hace menos de dos años comprendió al fin que nunca triunfaría de esa manera, y cambió su estrategia. Desde entonces está librando contra nosotros una guerra cultural, una contienda en la que es maestro, y para la cual cuenta con arsenales fabulosos y con medios que parecen inabarcables y ubicuos.
En esa guerra se inscribe la breve visita que hará a Cuba el presidente de Estados Unidos. Como es cultural, se apelará a un alud de medios de comunicación, imágenes, anécdotas, noticias, sonrisas, alardes, paseos, pitcheo y promesas sutiles de próspera paz. Como es guerra, habrá reclamos de que hagamos concesiones políticas vestidas con ropa del atelier imperialista, procura de algunas simpatías, scoutismo y empresarios afables y prometedores. En suma, una guerra del siglo XXI.
Cualesquiera que sean sus motivaciones personales, Barack Obama es solamente un actor de una escena más, en un drama trascendental: la centenaria pelea de Cuba por la libertad y la justicia social. Hemos tenido todo tipo de adversarios, desde los más respetables hasta los peores, pero el lugar histórico de cada uno lo ha dictado la práctica revolucionaria del pueblo cubano.
Sin dudas, Obama es importante en la breve escena del gran drama en la que le ha tocado actuar. En alguna medida, puede aspirar a ser recordado por su buena actuación, o puede perder su oportunidad y seguir hacia el olvido al que lo historia lo sometería.
